Your query is not clear as to condonation of delay. Moreover, the Section referred to is inapplicable either of IPC or Cr.PC. Please elaborate?

There is very little chances to condone in such matters becuase law of crime is based upon beyond any reasonable doubt and delay itself creats much doubt.

challenging the committal court order, for given -up the accused with out any reports from IO or Complainant. Not taken the congnizance against accused, Who shown in Col No 2 of the chargesheet.

The reason is Complainant assumed that seperate case was registered for the given-up accused, and Complainant has no knowledge of Crinpical precedings. The accused not secured to court after issue of NBW and given-up in committal court.
