Maintenance denied

Respected all,

Do u have the case history of bombay high court which denied maintenance to the qualified women recently may be last week the order has passed. please post the details, it will deffinatly help many who all suffering in divorce case .....by paying huge alimony.

Please can somebody guide on ' HOW to PROVE in Court of LAW woman's educational qualification"

If Woman is Graduate + MBA.

Husband has details sent by wife during marriage (Only Family details , Qualification, Past work experience etc typed on a plain paper and in an envelope sent by them stamp of the PO of their residing place)

And email from the wife with attached resume and request for job search to husband.

Will these details stand in the court of law.

Qualified woman can’t claim maintenance: Court

MUMBAI: A family court has observed that a well-qualified woman cannot claim maintenance from her husband. "The wife who is well-qualified and claiming maintenance by sitting idle is not entitled to get maintenance. The wife is not entitled to advantage of her own wrong, she cannot harass the husband on the count of maintenance though she is capable to earn," the court said while dismissing a dietician's plea to seek a monthly maintenance of Rs 2 lakh from her divorced husband.

In the petition filed in 2013, the woman alleged that throughout their marriage, the husband and his family members had ill-treated her and harassed her both physically and mentally for bringing less dowry. She further alleged that they demanded Rs 50 lakh as dowry, gold and a luxury car from her parents.

The woman claimed that due to this, she was forced to live separately from April 2011 and had to move in with her parents. She also said that she had no source of income and is totally dependent on her parents.

As per the Bombay, Bandra Family court, the qualified  women cannot claim maintenance is right but whether it was upheld by the high court on appeal is to seen waiting for the same.

Family court decision and judgement is an obitor but not rule. Unless it will be a Rule such judgement shall not be applicable in all cases.

First of all this is a Family Court Judgment. It can not be used as a rule until it gets conformance from the higher forum like HC & moreover from SC. Media has hyped about the matter.

 

No doubt it is a commendable step by the Family Court Judge, but a long way to go before it could be referred in the different family court litigations.
