Legal heir certificate regards

Hi Forum,

A man died, If a legal heirs certificate doesn't show his son who died before his death without marriage (as bacholar) , then the certificate is valid?

Two cases

1. if that son was mentally disturbed

2. if that son was mentally healthy

It is believed that deceased was Hindu.

Even a predeceased son has a share............................as if he was alive and share of predeceased son can be claimed by his heirs.

The legal heir certgificate shall be as per inquiries made by revenue officials e.g Patwaari and report of e.g Kanungo.

It may mention ..................dead.

If a son died as bachelor then his Calss I legal heir is Mother and if even mother is not present then  ClassII heirs shall have claim.

 

A Legal Heir affidavit ( if acceptable) should also contain names (as truthful declaration) of all heirs.
