50 day marriage, death of husband

A lady hasbeen appointed as VLW in RDD department in J&K due to death of her husband only after 50 days of marriage. Can she remarrie with someone else? If yes then tell me what about those parents who take care of their son for 25 years. All amount given by compensation by govt takes away by that lady. In India there is no value of parents if your answer is yes. If your answer is no then what is the procedure to give some amount of her salary to the parents Plz reply

Obtain a copy of Compassionate Employment Rules of the establishment and copy of all affidavits, docs signed abd submitted.

If possible attach the rules/docs.

You may erase the names  etc to maintain confidentiality.

She cannot remarry now.  Because now it is iddat period, after completion of iddat period she might marry person of her choice.

Your answer may be in these docs and clauses.

It might have a point that the person given compassionate employment shall look after welfare of deceased employee. Take help of

The lady who has been appointed compassionately has  a duty to maintainher pRENTS IN LAW AS PER SENIOR CITIZENS ACT IF THEY ARE 60 YEARS AND ABOVE OTHERWISE PREPARED TO GO TO JIL ANSD ALASO LIABLE TO FINE OFD 5000 RUPEES.

During iddat period she cant remarry, if she remarry as per Shariat Law it will be void  marraige.

If she has got job on compassionate grounds, then it is for her conscience to give part of the salary she is getting through job of her husband to her parents inlaw.

If she is not giving, there is no use approaching to court, as approaching to court will take lot  of time and money also involved for lawyer fees and court fees.

Sit and discuss with the girl and settle matter amicably.  Holy Quran is to be read twice a day.

When a Government employee dies while in service, the members of his family (including parents) are eligible to get the following benefits. Encashment of leave, Special Provident fund-cum Gratuity, G.P.F balance, T.A. to go to native place, Advance to meet funeral expenses, transport expenses, to take dead body of the official to native place, lump sum payment under Employees Family Security Fund, Relief under house building advance, Educational Allowance to children, Compassionate Ground appointments to dependents, DCR Gratuity, Family Pension, Dearness Allowance, Medical Allowance, Pongal Gift. The salient features of these items except family pension are explained in Part I & II. Service records book must have maintained with parents name and wife & children to be incorporated in the service book.

she marry with a common man before 50 days when some militants came into house and fired the man and killed him. he was not a govt employee.

NO immediate need to approach court.

NO immediate need to ask/search for copies of Affidavits signed by all dependents of deceased employee.

 

Although one should keep a copy of a document signed by one.

Just downlaod the copy of Compassionate Employment Rules, Blank affidavits that are to be signed.

You may attach the ruls and blank copies.

Uusally the rules provide the person that is given compassionate employment has to look after welfare of the family/other dependents.

In case of violation by her her superiors can act against her.
