a magistrate convicted an accused person after due trial for the offence of theft.after the trial,but before conviction the accused person sets up plea that the magistrate has no territorial jurisdiction to try him.what is the legality of plea of the accused?

I think the plea of absence of territorial jurisdiction should have done before the commencement of trial and if not done so, it will not mitigate the trial by the magistrate at a later stage. But let the Learned members throw light on this if I am wrong.

he cannot raise such plea at such belated stage.
