Land tax for agricultural land

Hello,I have a doubt in regard with Land tax ,which is to be paid every year on the agricultural land .Now My doubt is whether if a person let him be X Who doesn't paid it since 5-6 years and that due by X is paid by another Y ,here do Y can have the rights over the land or Is there is any chance For X to reimburse all the money paid by Y for land Y .Will there be any legal issues ?

Hi! Thanks for the question! To answer this question it is necessary to know why and in what capacity has Y paid the tax for X. 

And even if he has paid he cannot pay the land tax on X's land in his name. If he has paid it with some malafide intentions then a penal action can be taken against him.

Another scenario where X himself has asked Y to pay for him - stil Y could not have paid it in his name and thus cannot have the rights over the land.

If you want to take an action against him, you should pay the taxes and get a receipt and then file a suit against Y and even on the authorities for fraud. Hope this gives some clarity. If you have any other questions, please feel free to ask and also give more information on the matter.

1.  Agricultural Land Revenue Tax, IF paid by "Y", denotes that  "Y" is cultivating the Land, and derives "cultivating rights", IF "Y" pays it continously for 12 years.  HERE the Tax receipt would state: Received from "X"  Rs. 100/-  THRU "Y".

2.  Issue Caveat to the Tahsildar /Talati, to stop collecting the Tax, from ANY third party, since you are in exclusive possession of the Land AND that not to make any entry into the Land's 7x12 form, in column titled as "other claimants".  IF this does not stop, THEN you need to file Civil Suit and make the district collector and "Y" as the interested parties, and get a declaration order.
