sale agreement

dear experts

if a purchases a plot of land makes a agreement of sale, but does not make a complete payment and also does not bother to register the document or make a proper conveyance. the agreement to sale is made 12 yrs back. the buyer fails to fulfill his schedule of payment. then after 12 yrs is the agreement still valid??? pls guide.

I do agree with Mr. Patil. its barred by limitation. if there is any condition to execute deed or make payment after certain period as you write 12 year than its still live.

If time is not essence of the said contract and its specifically mentioned then its still in force and u can demand for execution of sale deed,if there is no such specific clause three years from date of refusal to file a case for Specific Performance of Contract (to file a case to get sale deed executed thru court)
