What is the status of complaint/ FIR u/s 498A IPC ?

It would be better to consult a local prudent lawyer for better appreciation of facts, professional guidance and necessary proceeding.

Punishment under Section 498A is a maximum of three years but it had been made a cognizable and non-bailable offence.

In the State of AP and Telangana it is considered as bailable offence, hence the bail can be granted in the police station itself, but in other states it is non bailable offence, hence bail can be granted only by court of law.

The police are under instruction not to arrest the accused in such cases except with the approval of the SP of the District.
