Good Morning. I have a confusion regarding EWS certificate criteria. I have one elder brother( age 24). The land property is in the name of my father and we two are its claimants. So accordingly if it is divided into two I follow all the criteria under EWS. Legally it seems correct to me. But is it necessary that property should be divided and registered in name of both of us to get considered it divided. So will I be eligible for EWS or not. Kindly help me.
Sir we have agricultural land in village. If it is divided between two of us then we are in EWS category having less than 5 acres. Since it is not divided so are we eligible. The act on EWS doesn't define such situations so how to make a decision.
