Affidavit

There are many persons doing affidavits before Executive Magistrates through advocates.The point is the Executive Magistrate has no clue whether the person is truthful or not.So if an affidavit later be found to be false what punishment is there for the person and the advocate?Also is there any punishment for the executive Magistrate being oblivious of the facts?

If a person voluntarily files a false affidavit, then he/ she can be punished under section 191,193,195 and 199 of the Indian Penal Code for giving false evidence. Punishment for filing a false affidavit is punishable by imprisonment for a term ranging from 3 to 7 years.

Executive Magistrate is attesting signature of deponent (the person made statement on oath), he is not responsible for truthfulness or falsification of contents.
