Regarding consideration of the past ex-cadre/isolated post experience for the promotion

Hi, I am Arun Kumar Dhawan, working in Panjab University, Chandigarh since 2005.

In 2005, I have joined Panjab University as a Programming Assistant in the pay scale of 5800-9200.

After 8 years of job when I have applied for the promotion, the estt branch told me that you are on the ex-cade post which have no promotion avenue. After that I have started towards this to merge my post into the cadre group. After the long battle in 2022, the Universty re-designated me as a Senior Technican (Programming) Group-II.

In Oct 2024, I have applied for the post of G-1 (Scietific Officer ) within the clause 2.5 means you are eligble to apply within the Univesity promotional post.

In 2019, the rule is made by the university for the promotion of ex-cadre post, The following is the wording of Ex-cadre promotional post:

"The person working on Ex-Cadre/isolated posts in the teaching departments against the posts of Lab & Technical cadre under Clause 2.5 within the University and having grade pay equal to or more than Rs. 4400 /- but less then Rs. 5400 /-are also eligible for applying of the Group –I posts, the experience will be considered as that of G-II posts, subject to the condition that applicant should fulfil the qualification, work experience and job requirements of the department in which the post is notified. "

For the promotional post my application is rejected by saying that you have 02 years of experience only as G-II post. When I have asked that I have worked 17 years as Programming Assistant (which is considered as ex-cadre), what about this experience as this experience is equal to the G-II as per promotional rule.

The concerned person told me that as your post is merged with the G-II, your experience is countable only of that not of the programming assistant as now you are not working as ex-cadre.

Means my 17 years of job experience has made nulified. 

Please help me or share some judgement which solve my problem.

The concoerned person is not joining my both experiences (ex-cadre post (17 yrs) + cadre post (2yrs))

You file a writ petition before high court seeking relief and remedy to this effect.

Your long service cannot be ignored and the high court will consider the same if you properly conduct your case.

Yes, only the Constitutional Court can provide you the remedy.
