Hello,

 

I worked at Infosys from 2010 to 2013 before going to study in Ireland. During this time, the company owners and managers, along with the Karnataka police and airport police in Bangalore, spread rumors about me being a criminal to white people. As a result, I lost money and my investment. Now, I am deliberately traveling abroad again through the same city to see if they attempt to defraud me again.

 

Additionally, NRI parents have been contacting my Reddy and other caste roommates, telling them that I am a criminal. They even went to my college to support these claims. This situation arose because I scolded those who misbehaved with me. In the past, I used to frequent places where many bad people hung out, leading them to believe I was one of them and spreading rumors about me.

 

What type of police complaints should I file against my former employers and the Indian NRIs for the fraud they committed? They are also spreading rumors that I am uneducated, and even lecturers are involved in this. This is complaint on Indian masses and Indian exodus.

In cases of defamation, you can lodge a legal proceeding against the defamer under Section 499 of the Indian Penal Code. It states that one commits defamation by bringing or causing any false statement to be published concerning anyone to harm their reputation. In your case here, because your case is founded on the rumors spread by former employers and the Karnataka police; hence, these are likely to fall under the category of defamation, wherein there are no proven facts as the premise of the respective rumors.

The case specifically relevant here is that of Subramanian Swamy v. Union of India (2016), where the Supreme Court held it to be a criminal offense and that somebody involved in spreading false and damaging information could be penalized. Since your case also has international elements to it being an NRI, it would even possibly avail remedy before international treaties or even approach the National Human Rights Commission (NHRC). The case of R. Rajagopal v. State of Tamil Nadu, 1994 again reiterated the requirement of protecting one's reputation from acts of defamation and thus can be relied upon for grounding your case.

I dont know who's doing it!

Im not bothered about both. But the I'm bothered about the way people are stealing money from me.

  1. They didnt hire me in MNC's due to CEO rumours on me
  2. Police recommend immigrants to jobs it seems and they stole investment

So, where ever I spend money, someone tracks me eg., immigration consultants to Canada, they took lumpsums- one close to 40k and another more than 100k and I still did not get a visa. Know why? Thinking logically explains it, police have contacted them and stopped it because- no business owner will take money and promise a visa and go to jail. Isnt it? 

They are doing this for my investments on room rents, food and chai expenses, bus fares etc.

I would like to suggest you file a complaint for defamation under Sections 499 and 500 of the Indian Penal Code (IPC) as these sections tend to define and provide protection for people like you, based on the information you have provided.

You can go with the Criminal Defamation complaint if you really feel that your reputation has been harmed by the statements, causing you economic and mental distress. This can be referred to the case of Subramanian Swamy v. Union of India (2016), in this case Supreme Court stated that criminal defamation was constitutional, and the right to protect one’s reputation shall be enforced.

Additionally, if the defamatory statements were anyhow published online or on some digital channels, then Section 66D of the Information Technology Act, 2000 can also be included in the list also as you can visit the portal of Cyber Crime, India to file a complaint concerning online defamation or impersonation.

Since the harassment you are facing is related to caste, then you also have the option of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, as this act tends to provide protection to all individuals suffering discrimination and hate speech in the basis of caste.

At last, I would like to advise you to please file a complaint against all this, going with a civil suit for damages would be best as you have suffered harm regarding your reputation, and this may result in monetary compensation once proven.

Providing substantial evidence, like screenshots, digital records or statements of the witnesses will probably strengthen your case.

Thanks everyone. Last time I went to Ireland. 

Now I'm going London. If things go bad because of few things like:

1. My ex employers from England

2. My ex college from neighbouring country

3. Indian police 

I'll send all of them to jail, taking your support. Your all witness to my pain!
