Court order not followed?

Hello!

 

  1. Suppose there is a situation which is exactly similar to another person's case and for which writ petition has already been filed, then is there a need to file writ petition again or can i just present the case to the concerned authority ?
  2. Are Writ Petition orders only applicable to the conerned individal only or to the citizens of India as a whole?


Please guide.

Generally the authority does not act when somebody places before it that his case is also placed in the same footing, the authority will only act if there is an order that all such such simillary situated person be given the benefit. In this case when the case is pending which has been filed by a another aggrieved person, that means so long you does not aggigate you are not aggrieved. Since one case is alrady pending see the stage of the case whether it is ready for final hearing, then in that case wait for the order.

Ordfer or Judgemnet is applicable to every citizen of India only when there is a specific direction or when the court forms a opinion that authorities should take this or than particular view in these types of case. Otherwise it is ordinarily presumed that the order is basically on the person who has approached the court.
