Court permission to block a lane in a residential area

Hello Everybody,

I live in a residential colony of Secunderabad, Telangana. For years our colony residents have been facing nuisance and inconvenience due to heavy traffic from surrounding colonies. The residents living in the surrounding colonies have been using our colony's internal road as a shortcut to avoid the main road. These colonies are well connected with main roads but they still want to use our roads as a shortcut. Every day more than 3000 vehicles use this 30 feet road. The vehicles which include cars, commercial autos, goods carrier autos and two wheelers are driven extremely rashly on this road. This has been causing air pollution, noise pollution, damage to public and private property and has been posing a serious danger to the lives of the residents who live in this area. There are two big schools in this area and school children can be found playing outside during their breaks. These vehicles are also posing a threat to these children. There has also been an instance where a senior citizen was killed by a speeding auto while he was walking on this road.

Because of this, our colony wellfare association has decided to block this road from one side by erecting a barricade. Residents living on either side of this barricade have access to a 40 feet road to enter and leave the colony without any difficulty. The only intention of erecting this barricade was to ensure that the outside traffic from the surrounding colonies is unable to pass through this particular road.

However, some local goons have been oobjecting to this barricade. The people who are objecting to this are not the residents of this colony. They are outisders. They are using the local police toand are ignoring the danger being posed and the inconvenience being caused to the people living in this area.

Therefore on behalf of our colony's wellfare association,I would like to know that if there is any provision in law which can help us with this. As the local police and the Greater Hyderabad Municipal Corporation is not being of any help, can we approach the Court and get a permission from them for erecting this barricade. I am sure that once we have the court's decision in our favor, no goons and politicians will be able to object to this.

Kindly help with your suggessions.

Thanks,

Rohit Singh Rana

you need to go in high court and file application and demand to stop this coz you cant stop any one to pass on road but high court give some rule again pass the road

T. Kalaiselvan, Advocate (Advocate)     26 December 2015

Your colony association can file a suit for mandatory injunction restraining the outsiders from using the colony road which is exclusively meant for the use of your colony members alone and to permit the association to make arrangements accordingly to prevent unauthorised users from using the road meant for the colony purpose alone.
