Criminal case - Double cross by lawyer

My wife (belongs to Scheduled caste) has filed a police complaint regarding harrassment at working place, lewd comments, personal and professional comments by a collegue. Filed police complaint. Hired a lawyer. Give Rs.10000/- as his fees for filing court case and whatever necessary in this case. Police arrested that person and also immediately give him bail. The lawyer said to file for cancellation of bail and making draft, had not done anything and kept us in dark for 3 months. He take bribe from opponent side and had not filed for cancellation of bail. He even did not replied for our phone calls and even refused for meeting.

Now he has the original documents of the case and refused to return the same.

Suggest what we can do against that lawyer as well as in that case.

Police has not filed charge-sheet even after 6 months has been over.

YOUR ADVOCATE WORKING IN FAVOUR OF YOUR OPPONENT. MIGHT BE HE BRIBED HEAVILY. CHANGE YOUR ADVOCATE IMMEDIATELY. FOR COPY OF THE COURT  PAPER APPLY FOR CERTIFIED COPIES - DONOT WORRY FOR IT. COMPLAIN TO STATE AS WELL AS CENTRAL BAR COUNCIL AGAINST HIM.

Dear Mr.Rakesh,

You can lodge a written complaint against your Advocate in consumer forum for deficiency of service, bar council and local bar association where he is having membership.  Simultaneously if you can prove his wrongdoing you can very well initiate criminal complaint and suit seeking damages.

Can u also please suggest what can be done in that criminal case. As police has not filed chargesheet even after 6 months. Can we file now cancellation of bail in high court or anything whatever is necessary in this case.

Dear Rakesh,

                         You can go high court against the bail given to the accued i.e. in appeal against the bail allowed but not directly file the bail cancellation in high court . First you have to file the bale cancellation in the court concern or session court . My advise is that forget about the bail cancellation right now and move it after the chargesheet is filed . First you work for the chargesheet . For that give an application regarding progress report to the court .

As far as your complaint regarding your advocate is concern,complaain with full facts to the Bar Council of the State and they will depute a disciplinary comettie against your lawyer .
