Custody of minor

Hi I wanted custody of my niece who is minor as my sister committed suicide n her in laws are booked u/s 306 and 498A of IPC Kindly suggest me which act and section is applicable for taking custody of my niece Thank you

Thanks for reply But can you assist me with the section of Guardianship Act And whether I should apply for guardianship or my parents should ask for custody of child??
