A suit was filed by the plantiff at civil court whereby the witness in the will is not called by the lawyer at the time of evidencing, the suit was dismissed in favour of defendent, further the plantiff also filed an injunction previously which was withdrawn, now can he again file the injunction or the chances are that res judicata will be attracted, further if he will appeal to high court what is the relevent procedure and do he will ask for de novo trial , what is the remedy if the plantiff wants the trial again so that he can produce his witness which he had not produced previously and the matter is decided in favour of defendents.
