Hi,
one of our close relative lady has filed a criminal case for molestation under 354 D (i,ii,& iv), 354 A & 506 against accused.
The case is presently at Appearance stage in the JMFC court.
In the meantime the accused in rder to put pressure on the lady & her family has given an application to the police against the complainant that she is of bad character & not him she was after him & so on... Additionally the accused who is on bail is defaming the lady character in society & public.
My question is if the lady can file the defamation case against the accused based on defamatory application given by accused and the words spread by him in society. There are many people from society wh are with the lady & can give witness about what is told to them by accused.
