No, they can take defamation charges against the other party becuse the court proceedings are previleged and not meant to defame or damage the other party but to defend their case only. If it is published out side, then defamation and suit for damages can be filed.

Yes rightly said by Mr Sajneev,
Statments made in Judicial procceding will not give u right to file defemation BUT if the same is published or propounded outside to any third paerson then certaily u can file case for defemation for punishment or damage i.e in criminal law or civil law.
