Delay in flat possession

Dear Sir,

I had purchased a flat in march 2010 in kalian, possession date was given in the agreement is Dec 2013. however builder is delaying possession saying they are not received OC from municipality.

all my payments are done on time through the LIC housing finance. only final amount like society charges and some percentage pending after possession id due which I supposed to pay after possession.

I come to know builder had taken interest from few buyer for delay payment. but now they are not willing to pay us any interest.

can you give me any legal advised how to go about this.

I want to sell this flat and builder is asking for some charges in black for which he will not provide any receipt (black money). is there any provision that I can get NOC from register after one month if builder is denied to give the same.

take services of lawyer practising in consumer court. Arrange to give notice in writing for compensation in respect of delay in providing possession. thereafter, file consumer case and approach builder. He will give happily give NOC for sell of flat subject to withdrawal of consumer case filed by you.
