Dear All,
Due to some personal reasons me and my wife have decided to apply for divorce and the lawyers settled the matter. We agreed to pay a lupsum of 9 Lacs (through DD) to my wife and they agreed to file a ex party to speed up the procedure.
i took a DD in her name in the month of July and after 45 days, my lawyer gave that DD to their lawyer after an agreement on a white paper that they will present the DD in bank once we receive our divorce papers. And they agreed that they will file the case immediately.
Now that it's been more than 30 days that their lawyer claims that he filed the case and will share the details, but he is not sharing those details. And i am not sure that if they have already encashed the DD or not (which i will check once the bans are open tomorrow).
Meanwhile, my questions are:-
1. If they have already encased the DD, can i launch a complaint against them that they encashed the DD voilating the agreement that we written / made on the white papaer signed by her father?
2. Or is there a way that i can get back my money if they encashed with out even applying for the divorce.
