Irrevocable will - reg.

Dear Sir / Madam,

Looking forwarded for your precious advice regarding :

1) Can an Irrevocable will be made for a self acquired immovable property and got it             registered ?

2) What are the valid leagal points to be mentioned while preparing an irrevocable will in         India ?

3) Can a will be get registered in any Sub-registrar office in India, irrespective of the                 location of the property or only in the Sub-Registrar office whic falls in the jurisdiction         of the locality of the property?

4) Should a will be signed by all leagal heirs of the property

Ans: Will is always revocable

2) What are the valid leagal points to be mentioned while preparing an irrevocable will in         India ?

Ans: Sound mind and free will with two witness

3) Can a will be get registered in any Sub-registrar office in India, irrespective of the                 location of the property or only in the Sub-Registrar office whic falls in the jurisdiction         of the locality of the property?

Ans: Yes you can get it registered at the permanent residence of the Testator

4) Should a will be signed by all leagal heirs of the property

Ans: Not required

No will is irrevocable. There is no such document as irrevocable will. Execution of subsequent will automatically revokes earlier will without any declaration in the subsequent will that earlier is revoked. It is matter of time of execution of will that determines validity of will. 

A Will can be registered in any place including the place where the property is not located. 

A Will is prepared by testator towards the propertiesto which  he has clear and marketable title, it is not necessary that he should involve his legal heirs for preparing the Will.
