dismissal without enquiry

I was dismissed from my work in a private large scale industry .i was a permanent employee . Even i went to explain the show cause notice they did not accept .and intentionally credit the gratuity in my account through bank. Now case is in labour court. And they witnessing the gratuity paid to me is as I am not an employee and no rights to suit against them. Am i not qualified to get justice.

Payment of gartuity; Employer can pay gratuity without any application from employee.

The employer credited in bank a/c number that it had.

You may engage a very able counsel specializing in labor/service matters.

Since the matter is already in the court, it is better to discuss it with your lawyer. A small paragraph here will not be enough to understand and advice. It is very important to go through all the documents carefully before advising since the matter is already subjudice.
