Divorce -

Dear Sirs, Kindly suggest me the following : Husband and Wife are separately due to non-cohabitation for the past three years. Wife is willing to submit divorce application. If the husband is not willing to contest the divorce and if he is not attending for any counceling or hearing, What will happen for this case ? If ex-parte decision will be taken in favour of Wife, Will she get any compensation or maintenance allowance from her husband ? With regards, D.Dakshina Murthy

In absence of any reply, it is understood that you have no qualms about the petition and the application will go ex-parte.  Be it divorce petition or the maintenance application and both will go in her favor.


Its always advisable to not let any case go ex-parte.  Better appear in person or hire services of lawyer and reply to her petition.  Not replying will have its own adverse effects on you.

I accept your reply.  But the problem is that the Husband is not in our Country. He is in abroad.  His father is there in the Country.  Will it be possible to receive notice on behalf of his son and hire a Lawyer on behalf of his son and contest the case ? The wife is also another State.
