Divorce

Hello Experts,

I have filed a DV case against my husband in Sep 2015 and till now no decision has come. I got married on 14April 2010 & I have one son of 2.5years from this marriage.In Aug 2014 my husband left me and my son and in Oct 2015 he got married with his girl friend.

Now my question is if i will file a divorce will my DV case affects i need divorce certificate for removing his name from my documents and i have to put my sin in school so that i can prove that i am a single mother. I am fighting for my Son's maintanace as since 2.5years he has not given any money for his expenses.

Can anyone reply me as it is very urgent to get divorce certificate on 15th dec 2016 i will have to go to school for my sons admission and also my next hearing date is on 15th Dec2016.

I am Muslim by religion and he has sent one letter of talaq written in urdu from his Qazi. But i have not accepted that letter and sent back.

Please help.

Consult immediately a lawyer to issue a legal notice to your husband for maintenance and file a petition in family court nearby for maintenance for your and your child. Do it urgent.

Since you are from Muslim Religion, Your Divoce is already Happened, But you cannot obtain Certificate since you , yourself has NOT accepted his Talaq. So before the court of Law and DV Proceedings you are still his Legally wedded wife.

So, now option for your to file another suit in Family court, for getting status of Single mother, being wedded wife of your husband
