Sir, I have a divorce from the UAE and it has been attested by Indian Consulate in Dubai, how can I get a divorce in India?
I am an Indian lady aged 34 years married to a Ghana citizen settled on Dubai.
but now I am back to India, being an India by orgin, living alone with my 4 year old son.
It can be presumed that you married a foreign citizen in a foreign country and did not register your marriage in India under the provisions of foreign marriage act.
Besides, you have got your marriage dissolved by a decree of divorce in a foreiogn country's court.
Therefore neither your marriage is recognised nor you have to apply for declaration of decree of divorce as valid in India.
The Embassy attested divorce decree granted by an UAE court will be sufficient to prove that you are a divorcee.
