I am sureshkarthik i got married on 19 Feb 2010 wife lived with me for hardly one month. At end of month she said i am not interesting for marriage life since my family ( i.e. their family members ) said father would be dieing. Hence she accepted for marriage others i would she said to me and also informed me to take care of my life. I told this information to their parents . Since father in law is not well he didn't speak. But mother in law said she is young doesn't know any thing please hence i kept silent. I lost my father one year before my marriage.
Before accepting here as per our customer we went to see her in their house that time we clearly asked that she is 23 and i am 33 . there is huge age difference at that time they said we all know after knowing only we agree to get married our daughter. I place a request stating i need to speak with her. During our conversation i said clearly that my dad is no more , he has given reponsibility to take care of my family. My elder brother got married and he is staying in their in laws house. my younger is studying i am taking care of family and assisting for studies. Are you fine with this . She said yes. Since she said i also agreed for marriage.
Now she has filed HMOP petition against to seek divorce from me. Finally i went on hearing on may 27 2013 and told judge that i have no objection in providing divorce and i don't want to do counter argument and i don't have advocate to argu. Judgement announced next hearings on 5th June 2013. On 5th June 2013 i appeared court and told judge that only she filed divorce on me i haven't filed any counter argument and even in councelling she said she need only divorce nothing else and i am ready to give and asked judge that should i need to attend hearing still. Judge responded stating as per court of law we are not authorized to inform any individual to come or not to come and said , " Exparty order need to appear court on 17th June 2013.
My native is coimbatore. i am working in chennai. When i came of our chamber near to canteen i found lady advocate who was sharing their pleasant movements during their school and colleage day's i interrupted them by saying excuse me and said what judge told on regarding exparty order. She asked few question's.
Who filed divorce ? i told wife. Do i have any childrens ? i said we don't have. then no need to attend hearing any more. If i don't attend automatically divorce will be declared to her.
Yesterday 17th June 2013 i tried to speak with the opposite lawyer and asked what happened advocate said since she filed case of divorce judge verified marriage invitation and said next hearing on 27 june 2013. When i asked at what time they called for he got angry and shouted at me why are doing advocate job ? then i responded back saying this is divorce case on myself i am not asking what happened for others since it is my life involved i am asked only then he said next hearing on 27 june 2013.
Question : Required your expertise advise here that what should i need to proceed next during to workload i can't attend next hearing on 27 june 2013.
Her household materials is in my house + 2 and half soverign gold necklace and earing in my house. Earlier their advocate told when will i give them i told once after divorce confirmation. One week after that i would be giving. Actually i have spend Rs 75000 towards marriage. Rs 50000 for marriage and Rs 25000 for marriage saree and Thali etc.
Please advise me how i need to proceed further. there is no one to guide me. I haven't kept advocate on my side due to financial issue. Need to take of my mom. helping hand to brother studies, Repayment of interest for his education loan. my salary goes completely. Minumum six is there to comple his studies.
