Hi, I was married for 7 years, 1 daughter 8 years old, wife doctor(Mbbs MD), she earning 1.1 lac salary. I was earning more than her.
Me doing all household expenditures like child fee & her expenses, vacations, cook, maid, house rent(7 years), all basic & excursional needs of family, etc. She mostly saving her salary.
She bot a house without my knowledge wid da help of her parents. Initially I was reluctant but den we shifted & there too o started paying even da house maintenance, buying stuff for house & all child fee n new school admission fee (approx.4 lacs), etc. Doing all my family duties as a husband & Father. Infact as wife used to leave early for work, I used to get da child ready for school n drop her there, since da child was 1.5 years old.
Almost after a month in da new house(her house), I was evicted from the house wid my basic belongings kept at security guard room.
Post which she filed FIR & subsequent cases of Dv n maintenance. Now the cases r in da court. She's harassing me thru this even after my repeated attempts of reconciliation as I dun want our child to go thru this, but dey don't budge.
They also filed for interim maintenance which da court fixed for 40,000/month. However as I Lost My job during covid, we applied for relaxation as I dun have ny earning & am staying on rent. However da sessions court rejected my plea.
I have taken all possible steps to reconcile as I'm committed to dis relationship n my daughter.
1. How can I get interim maintenance reduced & have a stay on it. Haven't paid anything yet & 125 hearing is next month.
2. How do I quash 498A, 323, 406? As DV is a blatant lie n dey r using it for harrasment. They even applied for my bail cancelation ( will b heard next month)
3. As I have been defensive on dese false accusations & harrassment, pls help me in knowing how can I b on an offensive so that dey also feel da pinch of ruining my life n harrassment.?
4. They haven't let me meet my child for da past 1.5 yrs. A week back thru my custody case, court made them talk to my daughter over the phone in da court. But she's being coerced to say wot they have taught her. Even the judge talked to my child n asked why she didn't want to meet her father to which she replied, cos I beat her mother( which is 100%false). Infact I last 7 years we've only had 1 real discourse n dats it. Court has told her to bring my daughter to court next month for meet up. How do I get the custody or visitation atleast?
5. How long this harrassment n abuse can possibly continue?She's misusing the law & falsely implicating me.
6. Wot are the repercussions if I file for divorce now?
