If there any way so that i can force my husband to come to my city and file a case

I agree with Mr harsh, follow his advice.

You can file a case for divorce from your place, and then your husband will have to come to your place .

And by chance if your husband files a divorce case at his place, you can get it transferred.

If you are ready for mutual concent divorce then atleast your husband should come to your place, i mean he is supposed to come , when you are doing so much good to him. Divorce for free, then certainly your husband should come to your place. so file the case from your place.

Thanks Ms. Komal and Mr. Harsh for the wonderfull advice, I would like to ask one more question if i file a case against him and the sumon will go and if he do not receive or accept the sumon or if he accept and could not  turn up on the decided dates by court can after some time will the case be dissmissed or court decision will go in my favor.

I am sorry i am bothering you guys so much by asking so many questions, but ... i hope you can understand  :)

Hello miss sunita, thankyou verymuch.

If your husband doesn't accept the summons, then the papers will come back to court with a reason mentioned on it, if your husband has refused to accept it, and by some tricks he doesn't accept , then the reason will be their .  Court takes some time, some hearings atleast, if your husband doesn't turn up to any of the hearings escaping to recieve summons, then you can get the EX- parte divorce. And if your husband recieves the summons and still doesn't appear in court then your lawyer can ask the court to issue warrants against him. So don't worry, if you file a case your husband will have to appear, he cannot escape for long of forever.

Hi All!

I think one point of Sunita Sing is lost in between. Husband & wife agreed verbly for MCD, now if she wants to file case from her city, it will be on what grounds??

I think MCD ground will cease to exist as her husband will never give his consent in this scene (as she told about his strategy). If he signs papers of MCD to be filed at ur place then there is no prob.

O'wise Jurisdiction of SEC 13 HMA cases is:

1) Where marriage was performed.

2) Parties last resided just before separation.

The divorce case can be tranferrred from one place to ther by HC only, that too after proper procedure!

Thanks for your consent, but please tell me one thing my husband always play a game on a safer side now he has refused to come to my city to file a divorce if i need divorce then i have to go to his city where i resides before seperation, if me and my father will plan to go there i know he will not come to the court and will only harrase cause he never ever bother about the laws or relations.

Thats why i have asked is there any way i can force my husband to come to my city and file a petition for mutual concent.

Hello!

U can find ways to bring the jurisdiction to ur city, but question is -- how to force him for "MUTUAL CONSENT" u think in such case?

Is he sincere about MCD, I doubt!
