Dv and maintenance typical issue

Experts,

Would like to know if DV has to be filed police station or in the court .  will the public prosectuor going to argue the case or the party can hire a lawyer to represent the case.  Thanks in Advance.

 

Also, Would like to know if a DVC can be directly filed in Family court or it needs to be filed in the Megistrate court first and Family court is Appellate court for the same .

DV can be filed directly in the court and parties will have their own advocates and PP/APP will not represent them. If the aggrieved woman does not afford the advocate, she can ask for advocate and he will be arranged by the court free of cost.  Magistrate Court has got jurisdiction and family court is not the appellate court for DV cases.  In some areas, Family courts are directed to take up DV cases also as First Court.
