DVC exparte challenge

Ex parte decree can not be passed behind the back of the party, as it wil amount to gross injustice to the aggrieved party in the case. Yes, court can passed Ex parte decree provided there is clear and cogent evidence that one of the party deliberately and intentionally avoided to receive notice of the court.

dear sir , I submitted stay from high court in Dvc and our laywer has been said that no need to attend to court dates are giving by old judge and new judge has came given exparte order with out mentioning high court stay , can i reopen the case ? or else go to apeal to dist court ? if i went to apeal what was the releif i can get it ?
