EMPLOYEE TERMINATION OF SERVICES -

Hi,

          A employee having contract with employer of two years to perform services. It includes that employee has to provide a prior thirty (30) days notice prior to termination of services. As the employee has completed the two year term as per contract and still continues to perform services. 

In the event if employee wants to terminate his services with employer is it compulsory to provide thirty (30) prior written notice to employer.

Please suggest how should the employee proceed if he wants to terminate his services the reason is to relocate to his old parents .

Does the service continue without any specific renewal letter. In the letter of appointment the notice period is applicable to the employee within the term of two years or any extended period. Some companies would have 

a provision for automatic renewal by the company. Also does it provide for payment of salary in lieu of notice period. These points are important for suitable advice.

Dear Hemant, The two important paramount things in the facts and circumstances enumerated by your post are the Model Standing Orders the Organization has subscribed to and either serving the notice period or reimbursing the monetary equivalent by the employee in lieu thereof. In all probability if both the parties have extended the term of the contract the presumption is that the same has been extended on previous terms and conditions alone. More than legal it is a HR issue. It is advisable that the employee should have a one to one meeting with the HR and apprise them of his genuine problem and as a standard practice his notice period can be waived by HR. More than anything it is the good will that really counts. Let him leave with peace of mind along with certification by the employer about his work conduct and experience.
