Eviction Notice withdrawal by one partner

Tenant is a partnership Firm of 2 partners. Both the partners give a Joint Notice for eviction of the premises. Later one of the partners sent a notice saying that she does not want to vacate whilst the other partner says he wants to vacate. The landlord wants surrender of the premises.

What course of action should the landlord take in such a situation

The partner who is not willing to vacate the premises will have to be taken into consideration.  The landlord has to file a eviction suit in the court.

The landlord can adopt due process of law by filing a suit for eviction against the company/partnership firm on the grounds/reasons he rely upon for the purpose.
