F&f recovery

Hi Expert,

 

I have got F&F recovery on  gross ctc.Please help me & advise whether F&F deduction should be on gross or Basic.

In my appointment  letter .Below lines are mentioned.

You will be paid basic salary.Apart from you will b entittled to allowance/benefits/.

Notice period:  in case of shortfall in notice period,salary & other allowances for the days falling short of the notice period will be recovered from employee.

i was getting : basic,HRA,CONVEYANCE,EDU ALL,MED ALL,ADHOC ALL

The notice period/notice pay in lieu of notice period is part of service conditions that are governed by various enactments applicable to the establishment/employer/employee..........e.g. (name of the state) Shops and commercial Establishments Act, standing orders....................

The notice period/rate of notice pay is duly stated and can't be violative of the enactments.....

 

Relate with the enactment applicable in your case.

Thanks Expert,

I was working in Delhi & got trasfered to Banglore.

Please advise further what would be applicable on my case .Company Corportae office is based on Mumbai.

Look into the Act of your last state....e.g:

Delhi Shops and Establishments Act, 1954

:Sec;2(7,8,30),23,30,

 

 

The jurisdiction of courts can be either your last location/Redg. office of the company/jurisdictional courts as stated in appointment letter. YOur Labor Law Consultant can opine on it...
