Fake pf by previous employer

Dear Sir/Madam,
 
This is veda from bangalore.I want your suggession regarding pf a/c of my husband.He worked for Software company (vizualize technologies)in Mumbai for almost three years(2006-2009).After he left the company it has been over taken by the UK based company called LBi.Now we came to know that PF account maintained by  vizualize techlogies has been fake.Though they have mentioned PF A/C no in salary slip.We have requested  LBi through mail to let us know the pf details but not received any reply.
Is LBi  responsible for PF payment since it has taken over the vizualize?
Will we get the PF amount If we go  legally?
 So I request you to tell me how and where to approach to get this PF amount.

You have mentioned the company has mentioned PF number in salary slip, but the number is fake.

Has the employee received any PF accumulation report?

It shall be appropriate to first obtain a confirmation from concerned o/o RPFC that the PF a/c is fake, and lodge complaint with o/o RPFC. Later RTI appeal may be filed to obtain the status of complaint. The address, email id, phone number, fax number etc of both the companies may be mentioned in complaint.

Has the employee now accepted employment with new company. The employee should escalate the matter o the good offices of new company also.

Employee can lodge complaint with police, o/o Labor Commissioner, Ministry of Labor, for committing fraud.

Act as ap before the promoters of previous company disappear.

They have just mentioned the pf no as1234 in payslip.We have not received any pf accumulation report.

As you said how to get cinformation from concerned o/o RPFC without knowning  pf a/c  no,pf  office.

Has the company mentioned PF number as 1234 in all salary slips of all months?

Has this employee or any other employee ever wrote to company to supply them their PF number? Has the company not supplied PF number to any employee?

At the time of takeover did the company issue any communication to employees?

If the company has not issued/supplied PF number, and  if the company has not become defunct, the company must be maintaining office, therefore employee should either visit or write to company to supply PF number and PF accumulation reports. At the same time employee may write to good offices of new company also.

Previous company must have mentioned their registered office and corporate office address on appointment letter/salary slip/form 16 etc. While lodging a complaint registered office and corporate office address can be mentioned. RPFC of area of registered office is usually the concerned o/o PF commissioner.

The employee has to find out the addresses and do the spade work.

The employee can also visit the local o/o PF commissioner, labor commissioner and make inquiries.
