Family

1.in mcd case petition,affidavits of husband and wife,and all other necessary documents are filed in family court except compromise deed by counsel.

2.though there is mention of one time permanent alimony in both petition and compromise deed, there is no mention of payment of permanent alimony in mcd petition by counsel.

3.one time payment of permanent alimony to wife made prior to filing of mcd petition in court out of court.

4.cunning wife does not appear for second motion of mcd though 18 months have passed since filing of mcd petition in court.

5.what legal course is available to huisband  so that he will be sanctioned divorce decree by court?

Husband's payment of one time permanent alimony must have been shown as consideration and it must have received and acknowledged in the mcd petition filed. I am sure husband must have a receipt for the money he paid. There may be a procedural delay as she has to appear in person. There is no way she can rescind her obligation as she accepted the compromise and took money. Continue the compromise relations with her counsel.
