Flat booked possession not given

we had booked a flat in 2015, agreement states flat will be handed over within 1 year we have paid 93% of the flat value including Bank loan till date flat is not given possesion Agreement was for built up area Builder demand amount 20% for common area Please inform the Banks action if Builder is at default and does not answer the calls called by the Bank nor me.the flat is mortgaged to the bank if we are faulty bank will attach the flat BUT if the Builder is at fault what is the Bank 's role?? Dear querist,

 

Bank will not do much against the builder, bank will do everything to recover money from you in case you dnt pay installment in time than bank sell the mortgage flat and recover there  money and pay back bal amount to you.

As this type of case is seen everywhere where the builder is at fault, and the Flat owner is burdened by the Bank and the Builder who will demand " their pound of flesh " on the one hand to pay EMI and the builder not giving the flat.

As the Flat is mortaged to the Bank their must be some law to Grab the Builder if it is prooved by the flat owner that Builder is guilty as in my case  The Builder is not even listening to the calls made by the Bank.

We have filed the pettition in Rera also But to no effect. 4 dates have been passed but he did not turn up. Can we request Rera to take strict action? OR what other action we can take? Thanks for Your reply,
