We had submitted a proposal for the formation of Housing Co-opertaive society. There are 32 flats and 29 have agreed for the same. After issuing a notice to builder about society formation he came up saying that he has already done the Deed of Declaration and he wants to form an apartment. I just wanted to know if by only making deed of decalaration he can restrict us to form the co-op society?? Do we need to cancel the deed of decalaration first. The agent who is handling this proposal from our behalf says that unless and until builder registers 5 flats as apartment he cannot restrict us from forming a co-opertaive society. What are our chances of getting the co-operative society registered with deed of decalaration don eby builder.
