Full and final settlement amount unpaid

Hello,
I have been working in a software company from June-11 to Jan-12. The company from first only didnt paid me salary on time. Then from September they delayed too much for paying the salary. My September salary was given in december. Then i was given salary for October-11 and November-11 in form of cheques in January-12. Then the employer asked to drop only October cheque which was then cleared. Then at that time some other collegues dropped both the cheques and got them cleared.But after that the employer stopped my November cheque. After that i resigned from company and then after serving the notice period i was relieved from company.  But after that i havent still paid my salary for the month of November-11, December-11 and January-12. After asking regular times they havent paid me my full and final amount. So Sir i would like to ask you what steps can i take so that i can get my dues. Can i go to labour commissioner or is their any other way to get the dues. It would be thank full if you give me some suggestion. Thanks in advance

If you are yourself sure that you fall within the category of workman you can approach O/o Labor commissioner.You can approach a competent and experienced service lawyer with all records. Your lawyer after looking into your job profile etc can asses that you fall within the category of workman or not.Or you may have to approach civil court.Your lawyer may decide to sue the director for cheque bounce.Legal notice from your lawyer may also help.
