If at the time of registering a gift deed, the property(agricultural land) to be gifted is on the name of donor's dead husband's name; the property(agricultural land) had tenants(kul) & tenant's consent was not taken while doing gift deed.
Later legal heir search was carried out & property got transferred on donor's name(no other legal heir to donor's husband). Also later, the tenant's names were removed as per a court case's result.
Can the gift deed be termed invalid?
