Can you suggest what can be done when 498a and DV is going on?

File Defamation/Conspiracy? Can my mother/sister file these cases since they got the stay order from HC?

Solely filing of 498a/ DV is no ground to file defamation/ conspiracy.

Find some better ways.

Hello Mr Kapoor, Well I do have evidences which clearly proves their intentions. Mere filing these cases within 5 months of marriage says a lot about the intentions, and the way money is asked (Demanding one house and 50Kpm) as maintenance when the girl is making more than what boy is making.. gives some grounds. I am being attacked by a psycho, however hard to prove it legally. But a conspiracy is visible since the only motive was to make money by hook or by crook. What are the ways you would suggest based on your experience? In your case you just sustained the injuries of 498a and reacted like a mahatma?

Anger will only lead to more mess. Only you can decide whether you want to prolong the 498a or not. Filing cases on them can be done anytime. Doing it now and then ensuring they dont take the 498a back hurts your chances of finishing the case soon since these cases take years. Would you like to be suffering for many years including your family with mental worry and money going for law case. So just think about it.

Also, what has happened so far in your case. Have you got bail and in how much time. Has the chargsheet been filed. A weak chargsheet can help you dismiss the case. Let us know the details and like you said take it step by step.

I appreciate your and Mr Kapoor's concern. I am planning to file divorce at this moment. I will only file defamation and conspiracy after my complete aquital from these cases. How does that sound to you?

I have strong evidences:- 5 months of marriage. We left our parental house within a month and living separately. Girl's behavior changed after hardly a week of the marriage. She started threatening me of false charges on me and my entire family. - Statements are recorded through cellphone - I will get those authenticated from Truthlabs.org. Before doing this 498a she accepted through an email that she want a divorce from me. 

As a psycho she used to threat me about making a scene at my parental house which she did and my father died of a heart attack after this incident. Do you think I should just sit back and do not act? What did my father do to her, my mother, my elder sister??? How any one can torture and harrass in the name of law? Are we living in Taliban?? I will take action against them no matter what it will take

Wait till the case gets over and then do what you want to do. Hopefully you will do the right thing.

Sure. Thanks for your advice I will keep that in mind. What do you mean by basis on the chargesheet? I have the chargesheet copy. My next hear is in September second week.
