Gratuity - Denial

can an employer having less than 10 employees deny gratuity claim.

The Sec.1 od PGA, 1972 ste that applicability of the Act is "Institutions employing 10 or more persons.  According to my interpretation and understanding including 10 brings them within ambit of the Act.
