Gratuity query

DEAR RESPECTED LAWYERS,

MY BROTHER HAVE SERVED A COMPANY FOR 6 YRS, BUT DUE TO POOR PAY PACKAGE HE HAD RESIGNED COMPANY WITHOUT SERVING ANY NOTICE PERIOD (NOTICE PERIOD WAS 60 DAYS).

NOW THE COMPANY ASKING TO PAY NOTICE PERIOD OTHERWISE THEY WILL NOT PAY ANY GRATUITY.

KINDLY ADVICE IS THERE ANY LEGAL PROCESS TO CLAIM GRATUITY IN THE ABOVE CASE.

Notice to be serviced before giving resignation. Otherwise management file a memo against employee. It may be one of the grounds to deny the gratuity. Why do you give a chance to management for your loop hole. Give a notice and resign.
