Guide me

Respected Sir,

My self joined as Quality Assurance Officer at Textiles Committee, a stuary body under Min. of Textiles, Govt. of India since 16/07/2007. Later on, on 15/4/2008 I wrote a letter to our Chairman (Chairman of Textiles Committee) to get 12 month study leave for Ph.D. (Physics), which was granted by competent authority subject to the following conditions that follows;

1. After competing the Ph.D. course, the applicant (me) will be continue to be employee of the Committee according to the rules and regulations.

2. The applicant will be paid salary during the course according to his eligibility as per  rules and regulations as applicable.

3. If applicant resigns from services or otherwise quits without returning to duty after the period od study leave or within a period of three years, the applicant shall be required to refund actual amount of leave salry together with interest & any other expenses, if incurred by the Committee.

4. The applicant should, on his return submit a full report on the work done by applicant while on study leave

 

A bond was submitted by me of 250000/- . which follows above four conditions.

After return of 12 month study leave , i submitted a full report on esearch work carried out by me during the 12 month's period.

As Ph.D. is of minimum two years, so later on 18/06/2009, i further requested to competent authority to grant me another 12 months study leave, but refused. Later on requesting many times I got extraordinary leaves of 5 months in 2011 and 3 and half months in 2012 for my research work. Now i got the degree Ph.D. (Physics) and wanna to resign.

Advise me on which date i have to resign such that no bond conditions apply on me.

Only no.3 condition will be of consequence to you, that is refund of leave salary.  But as you reported back to duty, that will not affect you anyway.  If you had resigned during the study leave or don't return for three years after study leave(/date from which leave is obtained?...vague) then only you have to refund leave salary.  Though it is vague, as you have returned to report back to duty that is not applicable for you.

After completion of 3 and half months leave, report to duty, submit report regarding the research work done and successful completion of Ph.D., work for a month or two and leave the job.

Are the Extraordinary leaves taken for Ph.D. studies countable in three years time mention in bond ?

YOu have to study leave rules of your organization.  Every organization has its own set of rules, it is not common for all organizations.
