Hefty penalty of 7 lakhs charged by builder

Hi All,

I have a builder floor in RPS, Faridabad. I booked it in Sept 2010. But suddenly in Jan'2014, builder has charged me 7 lakh rupees as late fees penalty. Whenever I received the demand letter from builder from the beginning, it does contain the line that i'll be charged penalty@24% per annum on the due amount but this late payment penalty was never charged to me in any subsequent demand notices, even though there was delays on my part to make payments. So, I was under impression that builder is a nice person and he knows that his project is visibly in same state since 2 years (approx.) so he is not charging late payment. But suddenly in January i got the cancellation letter from builder and when I approached them they told me that i need to clear the due amount which includes the penalty of 7 lakh rupees. I was shocked to my nerves.

All this has been done deliberately by the builder to make people default on payments so that he can squeeze the hefty amount in the end. If I knew that builder is charging me then why would I wait for amount to increase to such a large extent. Generally, if we pay any bill after due date then we get the new bill with late charges whether it's credit card bill, water bill, electricity bill, telephone bill, any bill. I spoke to my friend who has flat with JP builder, there also the late charges are added in the next demand notice.

This is a complete fraud and deliberate intent to make money by builder by taking advantage of investor's ignorance. 

If someone is experiencing same issue then please reply and please tell me what they did to resolve it or if there is any legal help available for such cases.

Is there any benefit of approaching consumer court.
