We have long back purchased a property through the society in my mother's name with my small business contribution & she built a small house & staying there. I have got two brothers one is constructing a house on first floor above my mother's house, incidentally I only has insisted my mother to permit him to do so, since he could not able to maintain his family my paying exorbitant rent, who is working as Manager cum Business partner in a Hotel. The other one is a Real Estate Agent, who earned substantial sum from the business staying separately, but having the Real Estate Office in my mothers premises.
My mother has offered me orally to get constructed some shops at the other vacant place of land & earn rent. since, I was staying away from Bangalore, for the past 30 years, & on & off I was visiting my parents with my family & children during holidays.
Of late, my brothers are insisting that the property should be divided amongst the two & not to offer any thing to me, since I
am staying away over the years. Since, my mother is getting adequate pension she is not dependent on these two & have not good relationship with their wives. But with my wife is ok but not interested to move out of her place.
Since my mother has acute acidity problem, some medicine is causing problem to her, which she mentioned during my recent visit. when I checked up with my younger brother, who is monitoring her health & found that the case of overdose & asked him to change the medicine in consultation with the Doctor who has prescribed the same. He suddenly became aggressive & violent start abusing me with foul language & rushed to attack me my mother intervened & poor lady got hurt by him.
Later on she was explaining me that he had business problem & family problem. which he could have discussed me. My intention was that she should have peaceful ending in our place after her demise we can take appropriate decision. hence, I did not go for any construction & the one my brothers constructed does not have their land allotted in writing up-till now.
Since, our business was small at that point of time we purchased the property in her name to obtain Loan for construction. a site ad-measuring 1200 sqft.in a prestigious area now the market price has increased to a many fold.
One more site was also purchased in her name by us with equal contribution from my father,& our business contribution. This was also with same motive to get Loan, she was a state govt
servant& had loan facility at concessional/nominal interest rate. Later on they sold that site ad.measuring 1400 sa.ft for a huge profit without informing me & my Real Estate brother has forged my signature on the agreement. I was got upset but kept quite since my father has pacified that he needs fund & he could not inform me as my mother has put a condition that I should not be informed, if she wanted to put her signature for the sale deed, instigation of my brothers. She demanded & got a portion of sold amount & a minuscule of the sale amount Rs.25000/- she sent a Bank FD saying it is her contribution to her grand children,i.e. my children.
On maturity I approached the cooperative bank for money & I got it, after a couple of days with interest. Later on I came to know that in between my brother with the aware of my mother, has forged my signature & en cashed the FD by submitting a Indemnity Bond, due to loss of the FD REceipt. Tx.
