My father & mother had 4 children's, in that first one is daughter & other 3 are sons, and my parents separated in 2000 due to some too much personnel family problems after daughter married. all 3 sons was living with father from their childhood in other house and my mother was living in my father ancentral property house. daughter & son in law supporting to my mother.
From 2005 to 2014 my father was paying 600₹ maintenance to my mother as per high Court order. my father was a former & had only 4.5 acres land.in 2013 my father got a divorce.
in 2005 my sister filed a partition suit against brothers & father.initially a jmfc court ordered to give 1/5th share including my father, my father went to appeal to district Court on 2010. in 2014 my father died by Heart attack.. in 2016 district Court ordered to give 1/4th share. now it is under FDP final stage. in 2017 my mother filed a maintainance case against 3 sons & it is still going in jmfc court.
my first 2 elder brothers did only SSLC, first brother is a former & married have a daughter & a son studying 10th & 8th respectively & 2nd brother is a auto driver still not married. and myself did automobile engineering & working as a house interior designer for less salary & just 2 year back married.
my query is:
we have property 4.5 acre & my elder brother doing agriculture works & me and my first elder brother have good relationship. in this land in 2016, I build a house by my lifetime earnings to get a marriage & also I invested money to drill bores in this land. I invested all my earnings on this land to drill bore & to build house. now I have loans because of this.
my sister who filed partition suit has 2 adult sons.
please some one suggest me how court will divide property & house between sister & 3 brothers?
how can I get this house & bore in the favor of me which I invested?
and one thing is why I have constructed house is because this rtc not included in court judgement, my opposite party missed this rtc.
and also some one please suggest me they have missed 2 rtc , is this possible to add these 2 rtc's in the judgement now under FDP?
and also there 2 more rtc number are changed recently by revenue department & not updated in the judgement, but same land, is this coming under property division?
we have 13 rtc's in 3 villages, total land only 4.5 acres.
please someone suggest me or guide me on above questions, that how to deal these cases. I am totally lost my control & life too much disappointed because of this much of family problems. but I must fight & live for the girl who recently married me.
