One of my friend who works for a small american recruitment agency as business manager has been false ly implicated by their management , The management is consists of Father, who is the managing director in india operation and son is operating from US .
my friend when left the organization to join in a new organization in early 2009, the father son duo on malafide intention has filed a case in sdjm court under fraud,cheating ,forceful entry etc etc(sec 420,plus other small charges) , with one witness who is also serving in his office as a business manager .the management also never gives any notice to my friend citing any show cause notice or anything .They have accused 10 person who also left the organization with my friend to join in new group.Also they left the organization beacuse last two months the company not able to pay the salary to employee.
on march 2009 suddenly police ask my friend to come to nearest police station to discuss and while reaching there in around 4.30 pm , he has been forwarded to court in the evening and tsdjm forwared him to jail , he also not able to aquire a good lawyer in a such a short time.Much to his agony and his family ,finally after 2 days he has been granetd bail by district session judge ..in his bail order the judge has commented that this case being just out of business rivalry beacuse of my friend joining in new US based firm.then through our sources we found that the IO of the case being bribed by the company owner to arrest my friend .The subsqent day the IO being transfered after we being taken the matter to the senior police authority
now since then its almost three years being passed ,but no results, neither the poice has submiited any charge sh*t nor any closure report.Also we discuss with various lawyer , but none give us a clear answer ,about how to dismiss the case as its a career matter for my friend to being free from any charges.also the company which filed the case has been closed since one and half years.
now my question ,
1)how we can dismiss the case in the court or in the high court as any crimnila case in a professional life is hindering his career growth.
2)the police has not submitted the charge sh*t nor anything for last three years, so till how many days if the police does not submit charge sheer under section 420, the case will be automatically dismissed ??
