Friends,
There is nothing like best lawyer, you need to go to court complex and talk to a few litigants who are in family court. Usually in divorce case, following is the procedure.
1. Filing of vakalathnama
2. Serving of notice to opposite party
3. Replying to notice/objections/filing objections
4. Marking of your evidence
5. Marking of her evidence
6. Marking of documents, 1 yours and 1 hers
7. Cross examination of both of you (each 1 date)
8. Further cross examination of both of you if any (each 1 date)
9. Judgement.
For each step 1 day.
And in between each day 3 months, like that your case should be over in Max 30 months ie 2-1/2 years.
Add lawyer strike, bandhs, judge transfer, opposite lawyer suffering from diarrhea, your lawyer suffering from loose motion, court holidays all put together 2 years.
So in around 4 years your case should be over with not more than Rs 50,000 advocate fees including your to and fro expenditure to court halls.
Do your math and talk to other litigants in family court who are roaming to family court, ask them how long they have been roaming, if their case is in argument stage and they have been roaming to court only for past 4 years then BINGO, simply select that particular lawyer and hire him or her for your case and pray that he will do his best in your case !
