How to save my parents gold gifted to my wife.

The relation ship between my wife and me has turned sour. She is also always fighting with my parents. Her parents are always threatening and may surely file 498A .However, we had never asked for dowry. Also i have taken adequate precaution for 498A , like submitting letters in Police Station. Also, several recordings where in, she and her parents have put what so ever allegation, but never a single word abt dowry. So, i am not much worried abt 498A.

However, i do fear 406. My wife and her parents have ordinary back ground. They hardly gave her any stridhan. Only, one small gold set, not worth more than 1.5 Lakhs. But my parents were sincere in marriage and they gifted her jewellery worth almost 10 lakhs during marriage ceremony. This is visible in the marriage video recordings. However no countersigned list was ever prepared by both parties for the exchanged items and gifts.

Her mother side jewellery is with her. The jewellery gifted by my parents is in the custody of my parents. I am sure, they will ask for it under 406.  is there any way, my parents can sae their given gold ornaments as they can see, that this marriage is on the verge of breaking ?   Please advise friends.

Bob, To claim that 10 lac worth of jwellery as hers, she should submit valid VAT bills.

Dear helping Hand,

     I think u mis-read, 10 Lac worth of jewellery gifted to her by my parents during marriage ceremony. So, obviously, she cannot have the bills , but she can demand it as her streedhan.

You have not described why she is fighting. Mere fact that there is fight in family it is not per-se and evidence of her being wrong party.

 

Many women fight for nothing and many fight back when suppressed.  Your descripttion is silent on the aspect if she is fighting for nothing or she is really troubled and reacts.

My dear do you think that 1.5 lakh worth gold (about 4 tolas on these days rates) is a small Qty?

 

You go to market and can get one set in 1 to 1.5 tola.

 

I have not heard of any Babaji making 4 tolas of gold to disciples out of bhabhoot.

One way you concede that “My wife and her parents have ordinary back groundDespite that so called ordinary background they have gifted such a Qty of jewellery (you are silent of any gold given to you or your family) to her and you believe that they were not sincere.  Only when your parents gifted gold worth 10 lakhs they were sincere.

 

Your parents did not gift anything which they could not part with to your wife as they have themselves taken back the custody of the same streedhan which they publically gifted to seek social glory.

There need not be any list.  The video is enough to say that gold (which you call worth 10 lakhs) existed was gifted by your parents as streedhan.
